I think he's referring to the fact that it's a hacked flash game that is not site locked to aph, and therefore vulnerable to leechers (Like Martin).

Well if the swf is uploaded to a swf hosting website like that one, it's in the public domain. As in, anyone can download it and play it. So it'd be no use to have a rule for it.
