No, if someone is in your house, they have a previous offense of home invasion, and are carrying a weapon, threating you, and you shoot but don't kill, you go to jail. I happen to know this first person. Something like this happened to my family, no one was shot, but that is what the police officer told us. "If he comes back, just fcking shoot him" and that's verbatim.
